Shilani Fair representation does not require the union to take every grievance to arbitration because this would create an intolerable expense for the union and management and would destroy the effectiveness of the lower steps in the grievance procedure. Grievance mediation, a form of ADR procedure, was discussed and compared to grievance arbitration, another ADR procedure. The advantages of grievance mediation varies among costs, informality, skills development, and others. However, despite these advantages, grievance mediation remains less frequently used than arbitration. Other forms of ADR open-door policies, peer review systems, and early neutral evaluation were also presented. Unions have a legal obligation to fairly represent bargaining unit employees in the grievance procedure. Although unions are not legally required to take eachgrievance to arbitration, they must consider and process grievances in an effective, good faith manner. Legal and financial consequences to the union and the employer can arise when the union violates its duty of fair representation. I think that the advantage of having workplace governed by a legally enforceable contract supported by rights arbitration is that both workers and employers cannot take advantage of a situation or be undercut by a situation due to the rights. The disadvantage is that employees can end up unhappy with the outcome and some outcomes can be harder to judge than others. I believe it is a good model for the 21st century. I believe the workplace should be backed by laws and rights due to the fact that employers try to take advantage of situations.

ADR, better known as alternative dispute resolution, is a method used by two parties to arbitrate and reach a settlement in a dispute so that both parties will be satisfied. There can be both advantages and disadvantages in having the workplace governed by a legally enforceable contract supported by rights arbitration.
Advantages of having alternative dispute resolution in the workplace include the ability to reach an agreement without having to go through the court. A third party will make the decision based on the evidence and facts that they are presented with in a matter. Arbitrators are not required to have to comply with legislation in regards to the field of the dispute. An arbitrator is not a judge or attorney.
A disadvantage of having alternative dispute resolution in the workplace is that many workplaces do not have unions in place and thus do not even utilize these dispute resolutions in order to come to an agreement. Because arbitration is not a decision reached in the court, there can be a question of whether the decided outcome is fair and just for both parties. Arbitration often has no set of standards, so this can make it difficult to find consistency. It is like a case by case basis on which decisions are made.
I do feel that this is a good model for the 21st century. I feel that a lot of issues in the workplace could be resolved through rights arbitration. Perhaps instead of having big lawsuits, more matters could be resolved quickly and more quietly but so that both parties are satisfied.
Jessica When computers are stationed in the patient rooms or in carts that means that room for office desks will decrease. Nurses will not have to go sit down at the computer before visiting a patient and instead they can bring the cart to the room with the computer or the computer might be in the room already. One issue with the carts that might occur is clutter in the hallways. If nurses become busy and they are all lugging around carts with computers it might cause traffic and clutter the hallways.
Patient rooms will need extra room for the carts with computers on them. Some rooms will be able to accompany this but rooms that are shared with two patients or more might have an issue fitting multiple carts with computers. One way they can overcome this is by sharing the one computer cart with multiple patients.
When carts aren’t being used the hospital will have to make sure they room to store the carts. Taking rid of desk space and using that unused space for carts would be a great idea to overcome this issue.
One last overall hospital layout innovation will have to be elevators. If a nurse has to travel to another level for a patient with a cart the elevators must be large enough to fit multiple nurses with carts and computers.
Deborah Technological change has helped to revolutionize the way hospitals are designed. In an effort to better meet the needs of their patients, today’s hospitals are transforming their layouts to become more efficient, and to facilitate a more customer-centered focus. In the case of Arnold Palmer Hospital (APH), its previous traditional process-oriented hospital layout was becoming less efficient, which led to customer dissatisfaction, particularly in terms of wait times. It set out to address its patient’s concerns by coming up with a new circular pod design for its new facility. The pod is modeled after the work-cell type of layout that is more familiar to the manufacturing industry than it is to healthcare. Work-cells organize people and equipment into a group so that they can produce one product or service more efficiently (Heizer et, al, 2016). At APH the new work-cells enable nurses and hospital staff to serve the needs of customers more efficiently by taking up less floor space, thereby bringing the staff closer to the patients. This empowers staff to be more effective and efficient because they are not spending the bulk of their day running up and down hallways to take care of their patients. Motion/time studies were conducted prior to implementing the new design to better understand how to save the staff time and energy through the hospital’s layout. APH also wanted to be sure that they were creating a healing environment that would provide a servicescape that would be more patient-centered (Pearson, 2021). This involved creating the right environment with the right ambiance that would help patients to thrive. For example, for the neo-natal unit, they focused on making it more “womb-like” by using soundproof flooring to make it quieter, and by getting rid of the bright lighting (Pearson, 2021). The results of the change from the traditional process-oriented layout to the new work-cell layout were a less fatigued and more efficient staff and better overall patient outcomes.

Many firms use distribution channels to make products and services available for consumers in different ways According to Armstrong & Kotler (2021). Distribution channels are a set of interdependent organizations that help make a product or service available for use or consumption by the consumer or business user. Distribution channels vary but typically include a producer, a wholesaler, a retailer, and the end buyer/consumer (CFI, 2015). Direct channels tend to be more expensive to set up at the beginning and can sometimes require significant capital investment. A perfect example for this is the television show Shark Tank. One of the sharks, Lori, has sold product through the channels of distribution such as QVC and other online b2c outlets such as Amazon. She has many connections and has the capital to back the product. Lori invests in them to get the ball rolling and connects them with major distribution channels to sell the products.
Indirect marketing channels are a bit different, and what these are is defined by how it sounds. If not directly to you, it is indirect, so retailers and manufacturers instead of selling their product through a channel that reaches straight to you, they will sell the product for others to sell, which are known as wholesalers or agents. In many cases these people will receive a commission in doing so. An example of this would be Mary-Kay or Rodan & Fields. Why I know about this is beyond me, but here we go. They get their product which is generally make up and skin care products and have women buy that product and then sell them to others. They may have shows or meetings to show off the products and they sell from their home in most cases.

Mitchell There are two ways that marketers use to attempt to sell their products to customers either through direct or indirect marketing channels. A direct marketing channel has no levels in between the product or service and the customer (Kotler & Armstrong, 2021) this means that the customer can buy its goods directly from the manufacturer, while an indirect marketing channels can contain one or more intermediary levels of distribution (Kotler & Armstrong, 2021) and the product is sold away from the place of manufacturing. An example of a direct marketing channel would be companies such as Mary Kay makeup, Herbal life or Pamper chief, these use door to door sales to sell their products while also using other means such as post office mailing orders or social media. Direct marketing channels look to sell the companies product directly to the customer without having to rely on intermediaries to sell resulting in a percentage for the product sold. Indirect marketing channels the product is built or assembled at a factory or warehouse and divided to locations for individual sales, the best example of an indirect channel is car sales. The factory produces the car at the plant and distributes the product across the country or world to individual dealerships.

Accoridng to Armstrong & Kotler (2021) Kohl’s has been considered a discount store, which carres standard merchandise sold at lower prices with lower margins, and higher volume. Other competitors simmiliar to Kohl’s are Walmart and Target. Based on the case described in the text, I would refer the Kohl’s ” Outfit Bar” to millinials who are interested in shopping and saving money. I personally do not like to buy my clothes at discount stores, becuase I pay for quality and style, however Kohl’s is targeting a certain market segment, and using technology to create an online experience, is helpful. Since many millinenials are on social media like Instrgram, it is a perfect way to reach consumers and create that relationship. I think is beneficial to utilize the social media personalities, becuase that will help influence the consumer and allow Kohl’s to break out of that typical discount store perception.
One top online retail competitor in the market now is Fashion Nova. According to Fashion Unitied UK (2021) Fashion Nova’s secret to success is their branding, using social media infuencers that model the Fashion Nova clothes. Celebrities also brand and market the clothing, reaching all markets, especially the millienials. I would advice Kohl’s to create value and competitive advantage, to stand apart.

David Kohl’s has been can be considered as a discount store, which carries standard merchandise sold at lower prices with lower margins, and higher volume than many of its competitors (Armstrong & Kotler, 2021). They also produce and carry some of their own brands such as Apt. 9. Other competitor’s similar to Kohl’s are Walmart and Target.
Kohl’s has done something quite unique with their introduction of the “Outfit Bar” and I can see this being heavily utilized by many millennials in the near future. I personally, maybe depending on the situation I would use it as a reference at the very least and I think my friends would too. Generally, I know my style, but sometimes you’re just not sure where to start, so even by looking at this outfit bar, it will show you some clothing combinations that you can draw ideas from and create your own, or you can buy based off of their creations. It’s a very versatile tool I feel.
If I had to give recommendations to management about rolling this out into its stores, I would give them the advice to roll it out in a few stores at first and those stores should be in larger markets. What this will allow for is the study of how this new product will be received amongst the consumers and what this will do is allow for them to catch any costly mistakes upfront before rolling it out into their many stores across the U.S which could be detrimental (Linton, 2020).
